Afternic Premium Promotion Service - specific conditions
These Specific Terms and Conditions and EuroDNS’ General Terms and Conditions shall be interpreted and applied together as a single instrument (the “Agreement”). All definitions contained within these Specific Terms and Conditions shall have the same meaning as those defined in the General Terms and Conditions.
1. The Service
EuroDNS shall enable the Customer to join the Afternic Premium Promotion Program developed and provided by NameMedia Inc. (the “APP Service”) as described herein insofar as the Customer has placed an order for such service pursuant to the General Terms and Conditions.
EuroDNS is partnering with NameMedia Inc. to provide the Customer with a means to sell their Domain Name to interested buyers through a network of selected registrars.
2. Domain Name
The Customer expressly understands that the APP Service require to be associated to a domain name. The Customer further understands that the APP Service is only provided in conjunction with the acquisition of a domain name duly registered with EuroDNS.
As a result, should the Domain Name fail to be renewed, transferred to another platform, traded to another person, be deleted according to a court order or a settlement, or more generally ceases to be linked to the Customer and/or to EuroDNS, the Customer will lose any and all right to the APP Service which will be terminated. It is the Customer’s sole and entire responsibility to take the necessary measures regarding their Domain Name to avoid such termination and EuroDNS cannot be held liable for any loss or shortfall incurred because of such
3. Limitation of liability
By listing their Domain Name for sale through Afternic Premium Promotion Program, the Customer expressly acknowledges, understands and agrees that:
- EuroDNS shall not have any liability or obligations to the Customer regarding the listing and sale of their Domain Name through Afternic Premium Promotion Program;
- EuroDNS has no control over buyers and more generally over the all Afternic Premium Promotion Program and makes no representations as to the reliability or capability of the listing service offered by NameMedia Inc., or the qualifications of any potential buyer or the ability of any buyer to pay for the Domain Name; and
- EuroDNS does not collect, retain or have access to any credit card information of buyers nor does it process the payment of funds between the Customer and a buyer and therefore cannot be held liable for any non-payment by the buyer.
EuroDNS does not and cannot guarantee the sale or purchase of any domain name through the Afternic Premium Promotion Program.
4. Customer’s obligations
By subscribing to the APP Service, the Customer agrees to allow EuroDNS to disable any transfer lock feature associated with their Domain Name. The Customer also agrees that EuroDNS may terminate the Customer subscription to the APP Service for any reason, without prior notification.
The Customer further agrees that by subscribing to the APP Service, they expressly acknowledge, understand and agree that any domain name successfully sold in the Afternic Premium Promotion Program may be instantly transferred away from their EuroDNS Account into the account of the successful buyer of said domain name.
By using the APP Service, the Customer further agrees and consents to Afternic Terms of Service available at: http://www.afternic.com/agreement.php
5. Service modification
EuroDNS reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the APP Service with or without notice. The Customer agrees that EuroDNS shall not be liable to the Customer or to any third party for any modification, suspension or discontinuance of the APP Service.
